Agreement and operator
These Terms of Use apply when you access the public pages and materials available through www.by4si.com, by4si.com and public pages served at intelligence.by4si.com (the “Public Service”). The Public Service is operated by For Safety Group Inc. (4SI), 11201 North Tatum Boulevard, Suite 300 PMB #365, Phoenix, AZ 85028, United States.
By using the Public Service, you agree to these terms. If you use it for an organization, you represent that you have authority to accept these terms for that organization. Invite-only workspaces, product evaluations, APIs, purchases and deployments may be governed by separate signed terms; those separate terms control if they conflict.
Research is information, not a decision
The Presence Risk Index, Exposure Radar, reports, papers, methodology and related materials are general informational research. They are not an audit, certification, official register, regulatory finding, credit or insurance rating, legal opinion, investment advice, individualized security assessment or guarantee of completeness.
Scores, confidence labels, statuses and modeled ranges are versioned 4SI analytical constructs. They may change as evidence, scope or methodology changes. Source coverage may be incomplete, delayed, revised or uneven by sector and geography. You must review the cited evidence, uncertainty and relevant professional advice before relying on a material decision.

Permitted and prohibited use
4SI grants you a limited, revocable, non-exclusive and non-transferable permission to access the Public Service for lawful personal, internal business, evaluation, education and research purposes.
You must not:
- misrepresent 4SI research as an official finding, certification or endorsement;
- use the Public Service to make an unlawful decision about a person or to facilitate discrimination, surveillance abuse or physical harm;
- circumvent access controls, probe non-public systems outside the Responsible Disclosure Policy, disrupt availability or introduce malicious code;
- extract data at a volume or frequency that degrades the service, defeats access controls or violates source rights;
- remove attribution, copyright, provenance, methodology or risk notices;
- impersonate 4SI, falsely imply a partnership or use 4SI marks in a way likely to cause confusion;
- submit unlawful content, credentials, exploit material or unnecessary sensitive personal data through the general contact channel.
Intellectual property and citation
Unless stated otherwise, 4SI owns or licenses the site design, original text, graphics, software, research structure, taxonomies, compilations and 4SI marks. These terms do not transfer ownership.
You may link to public pages and quote limited portions with accurate attribution where permitted by law. Substantial reproduction, republication, resale, dataset redistribution, model training on protected 4SI compilations or creation of a confusingly similar service requires prior written permission unless an applicable legal exception independently permits it.
Third-party sources, names, marks and linked materials remain the property and responsibility of their respective owners. A citation or link does not mean that 4SI owns, endorses or controls the source.
Correspondence and feedback
You retain ownership of material you submit. You give 4SI permission to use a message and supporting material only as reasonably necessary to answer it, evaluate a requested relationship, investigate a report, correct the public record, protect the service or comply with law.
Do not send confidential business information unless 4SI has agreed to receive it under appropriate terms. General feedback and non-confidential suggestions may be used without an obligation to compensate you, but this does not transfer ownership of your pre-existing intellectual property.
Availability, links and changes
4SI may maintain, secure, modify, suspend or discontinue any public feature and may correct or update materials without guaranteeing uninterrupted availability. External links are provided for evidence and context; 4SI does not control third-party content, security, availability or privacy practices.
Material changes to these terms will be dated on this page. Changes apply prospectively from their effective date. Separate notice or renewed agreement will be used where required.
Disclaimers and responsibility
To the maximum extent permitted by applicable law, the Public Service is provided “as is” and “as available.” 4SI disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
To the maximum extent permitted by law, 4SI and its officers, employees and service providers will not be liable for indirect, incidental, special, exemplary or consequential loss, lost profits, lost opportunity, business interruption or loss of data arising from use of the Public Service. For direct claims arising solely from the free Public Service, aggregate liability will not exceed USD 100. This limitation does not apply where liability cannot legally be limited, including liability caused by fraud or willful misconduct.
You remain responsible for your decisions, systems, use of source material and compliance with applicable law. Consumer rights that cannot be waived remain unaffected.
Governing law and disputes
These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Subject to any non-waivable consumer right or mandatory jurisdiction, state and federal courts located in Maricopa County, Arizona have exclusive jurisdiction over disputes concerning the Public Service.
Before filing a claim, the parties should attempt in good faith to resolve it by written notice describing the issue and requested outcome. This does not prevent either party from seeking urgent injunctive relief or exercising a right within a mandatory limitation period.
General terms
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining terms will continue. Failure to enforce a provision is not a waiver. You may not assign these terms without 4SI’s written consent; 4SI may assign them in connection with a reorganization, merger, financing or transfer of the relevant service. These terms and incorporated policies are the entire agreement for the free Public Service.
